The Public Service Worker Protection Act: A New Era of Safety for Public Employees

Section 1: Short Title

This Act may be cited as the ‘‘Public Service Worker Protection Act’’.

This bill aims to expand coverage under the Occupational Safety and Health Act of 1970 to public employees.

Section 2: Coverage of Public Employees

The Public Service Worker Protection Act amends section 3(5) of the Occupational Safety and Health Act of 1970 (29 U.S.C. 652(5)) to include the United States, a State, or a political subdivision of a State in its coverage.

Key changes:  • Includes the United States, a State, or a political subdivision of a State in the definition of "employment" under the Act • Protects public employees from workplace hazards and ensures their safety on the job

EFFECTIVE DATE

The Public Service Worker Protection Act takes effect 90 days after its enactment, unless it applies to a State or political subdivision that does not have a state plan approved under section 18 of the Occupational Safety and Health Act of 1970 (29 U.S.C. 667). In such cases, the Act takes effect 36 months after its enactment.
