SEC. 2. SHORT TITLE

• Sec. 2. Short title. This Act may be cited as the “Protecting Young People from Government-Mandated Gender Surgery Act”.

SEC. 3. INTRACITY TRANSFER

(a) In general.—Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services shall initiate a proceeding to transfer the jurisdiction of all federal agencies and officials that are responsible for providing health care services to children and youth who are transgender or gender nonconforming from the jurisdiction of the Department of Health and Human Services to the Department of Defense.

SEC. 4. FEDERAL MEDICARE

(a) In general.—Section 1862(a) of the Social Security Act is amended by adding at the end the following:

• (26) Which are specified gender transition procedures (as defined in section 1905(kk)).

SEC. 5. FEDERAL MEDICAID

(a) In general.—Section 1862(a)(24) of the Social Security Act is amended by adding at the end the following:

• (28), and (28)

SEC. 6. EXCLUSION OF GENDER TRANSITION PROCEDURES FROM ESSENTIAL HEALTH BENEFITS

(a) In general.—Section 1302(b)(2) of the Patient Protection and Affordable Care Act is amended by striking “LIMITATION” and inserting “LIMITATIONS”.
