Civil Enforcement
Section 8 of FARA is amended to add new provisions for civil enforcement, strengthening penalties for non-compliance.
- Registration Statements: Any person who fails to file a timely or complete registration statement required under section 2(a) shall be subject to a civil fine of not more than $10,000 for each violation.
- No Payment by Foreign Principals: If a person is subject to a civil fine under clause (i), the civil fine may not be paid, directly or indirectly, by a foreign principal.
- Supplements: Any person who is required to file a supplement to a registration statement and fails to file a timely or complete supplement shall be subject to a civil fine of not more than $1,000 for each violation.
- Failure to Remedy Deficiencies: Any person who knowingly fails to remedy deficiencies in their filing within 60 days after receiving notice shall be subject to a civil fine of not more than $200,000, depending on the extent and gravity of the violation.
