Section 1. Short title

The short title of this Act shall be the “Diaper Relief Act.”

SEC. 2. Diaper relief for health savings accounts

(a) In general— (em>Any amounts) paid from a health savings account to reimburse qualified medical expenses incurred by an individual or on behalf of an individual shall include amounts paid for diapers.

SEC. 3. Diaper relief for health flexible spending arrangements and health reimbursement arrangements

(a) In general— (em>Any coverage) provided under a health flexible spending arrangement or a health reimbursement arrangement shall include coverage of diapers.

SEC. 4. Prohibition on retail sales taxes

(a) State, and unit of local government, may not impose a sales and use tax on the retail purchase of diapers.
