Section 1. Short title
This Act may be cited as the “Promoting Integration of Individuals with Intellectual Disabilities Act”.
SEC. 2. Definitions
- The term “intellectual disability” means a severe intellectual and/or developmental disability present from birth or early childhood that may impact one’s ability to learn, reason, communicate, and interact with others.
- The term “individuals with intellectual disabilities” refers to individuals who are diagnosed with intellectual disabilities, as defined above.
SEC. 3. Amendments
- Section 2002(a)(2)(A) of the Social Security Act (42 U.S.C. 1397a(a)(2)(A)) is amended by striking “the mentally retarded” and inserting “individuals with intellectual disabilities.”
- Section 12(d)(5) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1760(d)(5)) is amended by striking “the mentally retarded” and inserting “individuals with intellectual disabilities.”
- Section 15(3) of the Child Nutrition Act of 1966 (42 U.S.C. 1784(3)) is amended by striking “the mentally retarded” and inserting “individuals with intellectual disabilities.”
SEC. 4. Regulations
For the purposes of a regulation issued to carry out a provision amended by this Act, before the regulation is amended to carry out this Act—a reference in the regulation to “mental retardation” shall be considered to be a reference to “an intellectual disability,” and a reference in the regulation to “the mentally retarded,” or “individuals who are mentally retarded,” shall be considered to be a reference to “individuals with intellectual disabilities.”
SEC. 5. Rule of construction
This Act shall be construed to amend Federal law to remove the term “mentally retarded” and “mental retardation” without any intent to change the coverage, eligibility, rights, responsibilities, or definitions referred to in the amended provisions.
SEC. 6. Children’s Nutrition
“The term ‘individuals with intellectual disabilities’ means a severe intellectual and/or developmental disability present from birth or early childhood that may impact one’s ability to learn, reason, communicate, and interact with others.”
SEC. 7. Institutions
Section 2(1)(B) of the Civil Rights of Institutionalized Persons Act (42 U.S.C. 1997(1)(B)) is amended—
(1) in clause (i) by striking “disabled, or re-tarded, or chronically ill or handicapped” and inserting “physically or intellectually disabled, or chronically ill”; and
SEC. 8. Developmental Disabilities Assistance and Bill of Rights Act of 2000
Title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (42 U.S.C. 15001 et seq.) is amended—
(1) by striking “Intermediate Care Facility (Mental Retardation)” and inserting “intermediate care facility for individuals with intellectual disabilities”;
SEC. 9. Miscellaneous
