Restoring Biological Truth in Government Act (H.R. 4138 IH)
This bill, introduced on June 25, 2025, aims to protect the biological definition of sex and gender from being misused by government agencies.
Section 1: Short Title
The bill may be cited as the “Restoring Biological Truth in Government Act” (HR 4138 IH).
Section 2: Prohibition on Asking about Gender Identity
This section prohibits federal agencies from asking about gender identity on any form or survey, and requires them to provide only male and female options for sex or gender questions.
Section 2(a) – Prohibition
With respect to any collection of information conducted by or for an executive agency, the head of such agency:
- (1) may not solicit or obtain any information regarding the gender identity of an individual;
- (A) provide an option to select or mark on the form or survey that sex or gender of an individual is something other than male or female;
Section 2(b) – OMB Guidance
Not later than 180 days after the date of enactment, the Director of the Office of Management and Budget shall issue guidance to the heads of covered agencies on the implementation of this section.
