Section 101. SHORT TITLE
(a) This Act may be cited as the “Department of Defense Appropriations Act, 2026”.
SEC. 102. FINDINGS AND PURPOSES
(a) Notwithstanding any other provision of law, Congress makes the following findings and declarations:
- The Congress finds that—
- (1) The Department of Defense has a critical role in ensuring the national security of the United States;
- (2) The Department of Defense’s responsibilities include—
- (i) defending the United States against threats from abroad;
- (ii) providing for the common defense of the United States; and
- (iii) supporting the national security objectives of the United States;
SEC. 103. AUTHORIZATION OF APPROPRIATIONS FOR FISCAL YEAR 2026
The President shall submit to Congress a budget for fiscal year 2026 that includes an authorization of appropriations.
SEC. 104. APPROPRIATIONS FOR FISCAL YEAR 2026
(a) There are authorized to be appropriated—
- for fiscal year 2026, for the Department of Defense and military operations, $721,439,000,000;
- for fiscal year 2026, for the Department of Energy and nuclear weapons systems, $21,500,000,000;
- for fiscal year 2026, for the Intelligence Community, $22,400,000,000;
- for fiscal year 2026, for the Department of State and foreign assistance, $46,900,000,000;
- for fiscal year 2026, for the Department of Agriculture and rural development, $4,600,000,000;
- for fiscal year 2026, for the Department of Health and Human Services, $45,100,000,000;
- for fiscal year 2026, for the Department of Housing and Urban Development, $15,500,000,000;
- for fiscal year 2026, for the Department of Transportation, $66,600,000,000;
- for fiscal year 2026, for the Department of Commerce, $4,100,000,000;
- for fiscal year 2026, for the Department of Justice and law enforcement, $34,800,000,000;
- for fiscal year 2026, for the Department of Homeland Security and emergency preparedness, $45,400,000,000;
- for fiscal year 2026, for international peacekeeping and humanitarian assistance, $2,900,000,000;
- for fiscal year 2026, for the Office of Management and Budget, $1,300,000,000;
- for fiscal year 2026, for the Government Accountability Office, $150,000,000;
- for fiscal year 2026, for the Library of Congress, $50,000,000;
SEC. 105. APPROPRIATIONS FOR SPECIFIC PROGRAMS AND ACTIVITIES
(a) There are authorized to be appropriated—
- $1,500,000,000 for the National Nuclear Security Administration’s life extension program;
- $400,000,000 for the Department of Energy’s science and education programs;
- $200,000,000 for the Department of Defense’s cybersecurity research and development; and
- $50,000,000 for the Office of Science’s basic science program.
SEC. 106. PROHIBITION ON CERTAIN TRANSFERS OF TECHNICAL ASSISTANCE AND DEFENSE ARTICLES
(a) There is prohibited the transfer of technical assistance and defense articles from the United States to foreign governments, with certain exceptions.

(a) There is prohibited the transfer of defense articles and technical assistance to foreign governments, with certain exceptions.
SEC. 108. DISAPPROVAL OF CERTAIN CONTRACTS AND TRANSFERS
The President shall not approve a contract or transfer that—
- includes a provision for the procurement of defense articles and technical assistance from a foreign government;
- provides for the purchase of a commercial item that is primarily for the purpose of supporting defense activities;
- includes a provision requiring the United States to provide military training or equipment to a foreign country; or
- provides for the procurement of a commercial item that is primarily for the purpose of supporting defense activities.
SEC. 109. APPROPRIATIONS FOR THE DEPARTMENT OF DEFENSE AND MILITARY OPERATIONS
(a) There are authorized to be appropriated for fiscal year 2026, for the Department of Defense and military operations, $721,439,000,000.
SEC. 110. APPROPRIATIONS FOR THE DEPARTMENT OF ENERGY AND NUCLEARWeapons SYSTEMS
(a) There are authorized to be appropriated for fiscal year 2026, for the Department of Energy and nuclear weapons systems, $21,500,000,000.

SEC. 122. APPROPRIATIONS FOR THE GOVERNMENT ACCOUNTABILITY OFFICE
(a) There are authorized to be appropriated for fiscal year 2026, for the Government Accountability Office, $150,000,000.
SEC. 123. APPROPRIATIONS FOR THE LIBRARY OF CONGRESS
(a) There are authorized to be appropriated for fiscal year 2026, for the Library of Congress, $50,000,000.
SEC. 124. APPROPRIATIONS FOR CERTAIN OTHER ACTIVITIES
(a) There are authorized to be appropriated for fiscal year 2026, for certain other activities, $1,000,000,000.
SEC. 125. SPECIAL RULES
(a) The following amounts are not subject to the general rule of division under section 602(b)(5) of title 31:
- $2,500,000,000 for the Department of Defense and military operations;
- $1,000,000,000 for the Department of Energy and nuclear weapons systems;
- $200,000,000 for the Intelligence Community;
- $400,000,000 for the Department of State and foreign assistance;
SEC. 126. EFFECTIVE DATES AND APPLICABILITY TO FUTURE ACTS
(a) This Act takes effect on October 1, 2025.
SEC. 127. SPECIAL RULE FOR FUNDS UNDER SECTION 604(a)(7) OF TITLE 31
(a) There is no annual adjustment under section 604(a)(7) of title 31 for fiscal year 2026.
SEC. 128. TRANSFER TO THE FUNDING AND APPROPRIATIONS ACT OF 2019
(a) The amounts authorized by this section to be appropriated out of the general fund of the Treasury are transferred from the funding and appropriations act of 2019.
SEC. 129. RULES OF CONSTRUCTION
(a) This Act shall be interpreted in accordance with section 306 of the Congressional Budget and Impoundment Control Act of 1974.
