This Act may be cited as the ‘Department of Defense Appropriations Act, 2026’.

Sec. 5001. General provisions.

(a) Definitions.–In this subtitle:

(1) The term “department” includes the Department of Defense; and

(2) The terms “cost”, “fund”, “program,” and “project” have the meanings given them in section 11(a) of title 41, United States Code.

• Sec. 5002(a) General management and control.–The Secretary of Defense shall ensure that the department is managed in accordance with chapter 11 of title 5, United States Code.
• Sec. 5002(b) Personnel management.–(1) The head of each element of the defense establishment may, after consulting with the heads of other elements of the establishment and with the Secretary, prescribe personnel policies for that element. (2) Such policies shall be consistent with section 7251 of title 5, United States Code.

(2) Such policies may include provisions for the use of a uniform contract form.

Department-wide procurement policies–(a) In general.–The head of each element of the defense establishment may, after consulting with the heads of other elements of the establishment and with the Secretary, prescribe policies for procurement by that element. (b) Policies for procurement–(1) The policies prescribed under subsection (a) shall be consistent with section 2112(a) of title 41, United States Code. (2) Such policies may include provisions for the use of a uniform contract form.

Sec. 5200. Management control of department-wide activities–(a) In general.–The head of each element of the defense establishment may, after consulting with the heads of other elements of the establishment and with the Secretary, prescribe personnel policies for that element. (b) Policies for procurement–(1) The policies prescribed under subsection (a) shall be consistent with section 7251 of title 5, United States Code.
