Section 101. Short title.
This Act may be cited as the “Improving School Infrastructure Act of 2023”.
Sec. 102. Findings and purpose.
The Congress finds that—
- (1) The Nation’s schools are in need of modernization to meet the demands of the 21st century; and
- (2) The lack of adequate, safe, and healthy learning environments is a major obstacle to student success, particularly for students from low-income families or those with disabilities.
Sec. 103. Improving infrastructure of public schools.
(a) The Secretary shall ensure that all public schools are—
- Designed and constructed to meet the needs of students with disabilities, including students who have autism or other developmental disabilities;
- Equipped with modern technology, including advanced learning tools and computer systems, to support personalized learning; and
- Equipped with safe and healthy environments that promote student well-being.
Sec. 104. Prohibition on use of funds for certain purposes.
(a) None of the funds appropriated or made available under this Act may be used to
- Acquire real property;
- Purchase land for the benefit of a school district, local school board, or educational cooperative; or
- Make any other expenditure that is not specifically authorized by this title.
Sec. 105. Annual report on grant program.
(a) Not later than September 30, of each fiscal year, the Secretary shall submit to the appropriate congressional committees and make publicly available a report on the projects carried out with funds made available under this Act.
Sec. 106. Carry-over of certain applications.
(a) In general, the Secretary shall consider an application submitted by a local educational agency for a grant under this Act for a fiscal year if—
- The agency was not funded for the previous fiscal year but has been added to the priority list since then; or
- The total amount of unobligated funds from the agency’s current budget that can be used to match funds made available under this Act exceeds 25 percent of the amount obligated under section 104.
Sec. 107. Definitions.
(a) In this Act, the term “local educational agency” has the meaning given by section 7013 of the Elementary and Secondary Education Act of 1965;
Sec. 108. Authorization of appropriations.
(a) There are authorized to be appropriated for fiscal year 2024 for the purposes of this title $10,000,000,000.
Sec. 109. Transitional provisions.
(a) The Secretary shall ensure that all public schools that were funded under section 104 of the Elementary and Secondary Education Act of 1965 for fiscal year 2023 are continued to be funded under this title for fiscal years 2024 and 2025.
Sec. 110. Termination of funding for programs.
(a) Section 104 of the Elementary and Secondary Education Act of 1965 is terminated effective January 1, 2024.
Sec. 111. Effective date.
This Act takes effect on the date that this Act is enacted.
