Section 2. Expansion of Medicaid to cover diapers and diapering supplies.

This section would amend Section 223(d)(2) of the Internal Revenue Code, adding “medically necessary diapers” to the list of qualified medical expenses for Health Savings Accounts (HSAs).
Diapering Supplies
The amendment includes the definition of “diapering supplies,” which would include items like diaper wipes and creams.
This addition aims to ensure that individuals with developmental disabilities or certain mental health conditions have access to essential products to maintain their dignity and comfort.
Effective Dates
(1) Distributions from certain accounts.
The amendments made by subsections (a) and (b) would apply to amounts paid after December 31, 2025.
(2) Reimbursements.
The amendment made by subsection (c) would apply to expenses incurred after December 31, 2025.
Targeted Funding
Section 4. Inclusion of targeted funding for States for diaper assistance through the Social Services Block Grant Program.
This section would amend Section 205(c)(6) of the Social Security Act, adding “diaper assistance” to the list of eligible purposes for block grant funding.
Election Applicability
The amendment made by this section shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 on or after the date of enactment of this Act.
