A BILL
To amend the Controlled Substances Act to provide for punishment for the knowing distribution of fentanyl, if death results, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE
This Act may be cited as the ‘‘Death Penalty for Dealing Fentanyl Act of 2025’’.
SECTION 2. KNOWING DISTRIBUTION OF FENTANYL WHERE DEATH RESULTS
<p Part D of the Controlled Substances Act is amended
<p by adding at the end the following:
<p ‘‘SEC. 424. KNOWING DISTRIBUTION OF FENTANYL WHERE DEATH RESULTS.’’
<p ‘‘Any person who is convicted of an offense under section 401(a)(1) or section 416 by distributing, possessing with intent to distribute, or manufacturing fentanyl shall, if death results, be punished—
<p ‘‘(1) by death or imprisonment for any term of years or for life; and''
<p ‘‘(2) by a fine under title 18, United States Code.’’
