GUN CONTROL ACT OF 2023
This Act may be cited as the “Gun Control Act of 2023”.
SEC. 935. FEDERAL INTERSTATE FIREARM PARTS REPORTING SYSTEM
Sec. 935. Federal Interstate Firearm Parts Reporting System
(a) Establishment of the system- (1) The Secretary, in consultation with the Attorney General, the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, and other appropriate agencies, shall establish a national database to track information on the interstate shipment or transportation of covered firearm components.
- The database shall be accessible only to authorized law enforcement officers, prosecutors, and Federal agencies, as defined in section 1033 of title 5, United States Code.
(b) Registration requirements- (1) Subject to subsection (c), any person who knowingly ships or transports a covered firearm component in interstate commerce shall register such component under this section.
- The registration requirement applies to each covered firearm component, regardless of whether the components are shipped or transported together.
(c) Exemptions- (1) This section does not apply with respect to— (A) any shipment or transportation of a covered firearm component that is in compliance with subsection (a);
- or
- (B) any shipment or transportation of a covered firearm component that is for the purpose of repair, maintenance, or testing.
(d) Penalties- (1) Any person who knowingly violates this section shall be fined under this title, imprisoned not more than 1 year, or both; and
- (2) if the offense includes the shipment or transportation of not less than 50 covered firearm components as part of a single act, commission, conspiracy, or enterprise, shall be fined under this title, imprisoned not more than 10 years, or both.
(2) If the offense includes the shipment or transportation of not less than 50 covered firearm components as part of a single act, commission, conspiracy, or enterprise, shall be fined under this title, imprisoned not more than 10 years, or both.
